Abstract

Garnishee proceedings are a legal process used to recover debts owed to a creditor by seizing
funds held by a third party on behalf of the debtor. This Paper provides an appraisal of the current
state of the law regarding garnishee proceedings under the jurisdiction of the National Industrial
Court of Nigeria (NICN). It examines recent decisions made by the NICN in garnishee
proceedings, as well as appeals to the Court of Appeal. The article explores the legal and
constitutional issues involved in these types of cases and emphasizes the importance of a fair and
equitable resolution that protects the rights of all parties. The paper adopted doctrinalresearch
methodology and by analyzing recent developments and rulings, the paper aims to provide a
comprehensive assessment of garnishee proceedings in the NICN's jurisdiction and offer insights
into best practices and potential future developments in this area of law. The paper recommended
that as the law continues to evolve in this area, it is important to continue monitoring developments
and assessing their implications for best practices in garnishee proceedings in the NICN's
jurisdiction.
